Blogs and Defamation of character

I am unsure of the legal frame workwork that Blogs exist in. Is a blog covered by the laws of the country of the hosting organisation (eg USA for Live Journal) or the country of the poster?

In legal terms is a blog the same as publishing something in a newspaper or magazine or broadcasting it on TV? Would it matter if the post was made on a friends-locked post; or to an audience that did not include the individual or organisation being defamed?

How would I find out if posting something that is defamatory about someone on a blog would count as libel?

I've posted this as an open post so that you can link to it if you think someone who does not read this journal could advise.

Thank you

Mel

It's libel, and you can be prosecuted in the country of writing, the country of hosting *and* the country of reading - the libelled party does not need to have read it for it to be libel, so flocked posts are still prosecutable. From an ex-Demon abuse guy who you may have heard of ;)

(oh, and if you want any more info, I'm sure I can wheedle it out of him, he seems to know a fair bit about this, strangely enough...)

Surely a friends-locked post would be at most slander, because it's not a public/published remark?

This was a point that I was unsure about. However, consider a limited-distribution, subscription based magazine. Something published in that would be libellous and I was wondering if the analogy would transfer to blogs. I suspect that it would.

[identity profile] arachne.livejournal.com 2006-09-06 07:07 pm (UTC)(link)
Nope - slander is spoken. It's easy to remember because they both start with an "s". If it's viewable by an audience outwith the author, it's published - it doesn't matter if one person or a million people read it - it's libel.

[identity profile] countb.livejournal.com 2006-09-06 07:40 pm (UTC)(link)
It's only libel if it's not true, which is where it gets legally tricky.

[identity profile] arachne.livejournal.com 2006-09-06 07:50 pm (UTC)(link)
Well duh ;)
I was working on the assumption that that was understood ;)

Mind, it bears saying that the burden of proof is on the person who made the potentially libellous statements/claims. So, if you were to say "that ara, she's boffing Tony Blair", and I was a bit put out by this, the onus would be on you to prove that I was doing so.

I'm not, as it happens.

It'd cost 'im ;)

[identity profile] countb.livejournal.com 2006-09-06 08:01 pm (UTC)(link)
But you want to, dontcha?

(which is slander, I think)

[identity profile] arachne.livejournal.com 2006-09-06 08:11 pm (UTC)(link)
Nope, slander is spoken. Libel is published.

I'm *so* taking you to court, boyo :P

Are you suggesting I'm a bit Welsh?

[identity profile] whotheheckami.livejournal.com 2006-09-06 08:31 pm (UTC)(link)
...and that is a compliment and could never be interpreted as libel

My journal...my sandpit...my rules ;@)

[identity profile] countb.livejournal.com 2006-09-06 08:33 pm (UTC)(link)
Besides, I *am* a bit Welsh!

(my legs)

[identity profile] whotheheckami.livejournal.com 2006-09-06 08:36 pm (UTC)(link)
Well I'm not which bits of me are 1/8 Irish! But they'll be the ones most involved at the Pogues! Rar!

There's enough precendent with regards to other web and internet publishing for it to be seen as libel.

The Lawrence Godfrey case would definitely apply.

[livejournal.com profile] surliminal is, of course, the expert in this sort of thing. Internationally speaking.

I was about to suggest her :)

Mel, is all ok?

[identity profile] whotheheckami.livejournal.com 2006-09-06 06:08 pm (UTC)(link)
Yes, nothing to worry about. Just random musings whilst driving the van around the Leicestershire countryside

[identity profile] trav28.livejournal.com 2006-09-06 06:09 pm (UTC)(link)
aha, I see. I just had a "Postman Pat" moment there. You didn't have a black and white cat in the co-pilot seat did you? Or a wookie?

[identity profile] whotheheckami.livejournal.com 2006-09-06 06:13 pm (UTC)(link)
Nope - I'm a single seat fighter jockey - no nagging ballast for me!

[identity profile] trav28.livejournal.com 2006-09-06 06:14 pm (UTC)(link)
Wookies don't nag, but they're no substitution for a good blaster at your side, kid.

LOL
Have you found the awesome Star Wars deleted scenes stuff on Youtube...the original Biggs in Anchorhead scene?

[identity profile] trav28.livejournal.com 2006-09-06 06:19 pm (UTC)(link)
Hell yeah!

I actually saw them 5 years ago on an interactive CD Rom called "Star Wars: Behind the Magic". Koo Stark cameos aswell ;)

A very good point. I'm not sure if she still reads my babblings. I shall email her at her shiney new email address

[identity profile] mazzarc.livejournal.com 2006-09-06 07:14 pm (UTC)(link)
Hmmm.. that leads me to another interesting question... can stating *your opinion* of something/someone be considered slander/libelous if it's made plain that it is your opinion... ie can your opinion be illegal?

e.g. PersonX is smelly. vs I don't like the way PersonX smells.

[identity profile] countb.livejournal.com 2006-09-06 07:46 pm (UTC)(link)
AIUI -

PersonX is smelly - libel (if they aren't)
I don't like the way PersonX smells - slander as it implies they smell bad

So your opinion can be slanderous even if it's fact, but only libelous if it's not fact.

[identity profile] siani-hedgehog.livejournal.com 2006-09-06 08:37 pm (UTC)(link)
i'm not sure that's right. i'm pretty sure that anything which is clearly stated to be opinion is allowed.

Except that his use of the phrase is now considered to not mean anything and no longer works as a get out of jail court card.
